Introduction

Trademark classes are categories used to organize the different types of goods and services for which trademarks are registered. There are 45 classes in total, covering everything from chemicals to clothing to services like advertising. Before applying for trademark registration, identification of the class or classes under which your goods or services fall is the most important step. 

The International Classification of Goods and Services, as per the NICE Agreement, divides products and services into 45 distinct categories. (classes 1-34 include goods and classes 35-45 include services). This classification system is widely recognized globally, making the process easier to apply for trademarks internationally. Every business entity, willing to register a trademark for a good or service, has to choose from the appropriate class, out of the 45 classes. 

In this blog, we shall discuss the items classified under  Class 1 for trademark registration.

Meaning

Trademark Class 1 is one of the Nice Classification, an international system used to categorize goods and services in the chemical industry for trademark registration purposes. Class 1 covers a wide range of products such as  Chemicals for use in industry, science, and photography, as well as in agriculture, horticulture, and forestry; unprocessed artificial resins, and unprocessed plastics; fire extinguishing and fire prevention compositions; tempering and soldering preparations; substances for tanning animal skins and hides; adhesives for use in industry; putties and other paste fillers; compost, manures, fertilizers; biological preparations for use in industry and science. 

Trademark Class 1 prescribes the following goods:

a. Chemicals for use in industry, science, and photography, as well as in agriculture, horticulture, and forestry;

Example: Ambuja Cements is India’s top cement manufacturing and supplier company registered under Trademark Class 1.

Example: TATA Chemicals Ltd. is a Multinational Company engaged in manufacturing specialized chemical products and crop protection.

b. Unprocessed artificial resins, unprocessed plastics; 

Example: Reliance Industries Limited is one of the famous companies engaged in producing unprocessed plastics and polymer products.

c. Fire extinguishing and fire prevention compositions; 

d. Tempering and soldering preparations; 

e. Substances for tanning animal skins and hides;

f. Adhesives for use in industry;

Example: Pidilite (Fevicol) is a prominent name in the Indian market known for its adhesives and industrial chemicals.

g. Putties and other paste fillers; compost, manures, fertilizers; 

Example: IFFCO is known for its fertilizers and agricultural products in the Indian market.

h. Biological preparations for use in industry and science.

Inclusions and Exclusions under Trademark Class 1

Class 1 primarily consists of chemical products utilized in industry, science, and agriculture, including those that go to the making of products belonging to other classes. 

Specifically, Trademark Class 1  includes the following:

Sensitized paper;

Tyre repairing compositions;

Preservative salt (excluding foodstuffs);

Certain food industry additives such as pectin, lecithin, enzymes, and chemical preservatives;

Ingredients for use in the manufacture of cosmetics and pharmaceuticals such as vitamins, preservatives, antioxidants;

Filtering materials such as mineral substances, vegetable substances, and ceramic materials in particulate form;

However, the Class 1 excludes the following in specific which are as follows:

Raw Natural Resins (Class 2)

Semi-Processed Resins (Class 17)

Chemical Preparations For Medical Or Veterinary Purposes (Class 5); Fungicides, Herbicides And Preparations For Destroying Vermin (Class 5)

Adhesives For Stationery Or Household Purposes (Class 16)

Salt For Preserving Foodstuffs (Class 30)

Straw Mulch (Class 31)

Steps involved in registering Trademark under Class 1

  • Initial Trademark Search

Before starting with the registration process under Trademark Class 1, a detailed Trademark Search is required to be conducted to ensure that the proposed trademark is unique and does not conflict with existing trademarks under Trademark Class 1. Search can be carried out online through the official website of the Trademarks Registry.

  • Prepare and Draft the Trademark Application

For preparing and drafting the trademark application form (TM-A), the following information and documents are required to be collated:

  • A clear representation of the trademark 
  • Details of the applicant, including name, address, and nationality
  • Description of goods or services associated with the trademark
  • Date of first use (if applicable)
  • Power of Attorney (if filed through an attorney)
  • Digital Signature of the Applicant 

The application can be filed online through the official website or a physical application can be submitted at the nearest Trademarks Registry office.

  • Submit the Application

The trademark application can be submitted online or offline by paying the requisite fees. The fee varies depending on whether you’re an individual, a startup, a small enterprise, or a large corporation. 

  • Examination by the Trademarks Registry

The Trademarks Registry will review the application to ensure it complies with the relevant laws and regulations. They will assess the distinctiveness of the mark, potential conflicts, and other requirements.

  • Publication in the Trademarks Journal

If the Registrar finds no objections or issues with your application, your trademark will be published in the Trademarks Journal. This publication allows interested parties to oppose the registration within a specific period (usually four months).

  • Objection and Opposition Period

During the publication period, objections or oppositions can be filed by third parties against the proposed trademark. If an objection is filed, the opportunity to respond shall be granted.

  • Registration Certificate

If there are no valid objections or if you successfully resolve any objections, the Registrar will issue a Certificate of Registration for a trademark under Class 1. This certificate confirms your exclusive rights to the mark within Trademark Class 1.
